St. Marlo Homes and Real Estate Pool Rules for 2006

POOL HOURS

1. The 2005 Pool Season begins on Saturday, May 14^th for weekends only until Monday, May 30th - Memorial Day. Those weekend hours will be 10:00 a.m. to 9:00 p.m.

2. The regular season pool facility hours of operation begin May 30, 2005 and continue through September 5th, 2005. Hours of operation are 10:00 am to 9:00 pm on weekends and 11:00 am to 9:00 pm. weekdays. Weekend hours apply on September weekends, ending Sunday the 11th^st.

3. School Day Operation: August 15- 19, August 22 - 26, and August 22- September 2. Guarded pool hours will be 4:30 to 8:30 on weekdays.

4. Swimming prior to posted hours in the mornings is allowed on normal days of operation (5/30 through 9/5), beginning at 5:30 a.m. each day. Owner will be expected to leave the pool for Swim Team practice hours, which are 8:00 a.m. through 11:00 a.m. through June 25th. These are considered "Swim At Your Own Risk" hours when a lifeguard will not be present. The Association will not be held liable for an individual's safety during these hours and discourages solo swimming. Swimming after posted hours is prohibited.

5. On days when attendance is low, Swim Company may reduce the number of lifeguards at their discretion.

SUPERVISION

1. No children under the age of twelve (12) are permitted to swim without an adult present that has explicitly agreed to supervise such children.

•2. Baby-sitters must be eighteen (18) years old in order to supervise any child less than twelve (12) years old. Requests for variances from this rule should be presented to the Pool Committee and kept on file in the Property Managers office.

ENFORCEMENT OF RULES

1. Lifeguards, when on duty, are responsible for the enforcement of these rules and have the authority to expel and/or reprimand anyone, at any time, for failure to adhere to pool rules, for misbehavior, use of abusive or foul language or apparent intoxication.

•2. All members and guests are expected to respect the lifeguard's authority and direction. Members should assist in the enforcement of pool rules by notifying lifeguards of violations during lifeguard hours. During "Swim At Your Own Risk" pool hours, members have the authority and responsibility to personally enforce pool rules and /or communicate violations to Pool Committee members, the Property Manager, or St Marlo Security as appropriate.

•3. All members should familiarize their children and guests with pool rules and require their enforcement. Members are responsible for the actions of their children and guests and must accompany them to the pool area.

•4. Anyone may be expelled at any time for failure to follow pool rules, misbehavior, or use of abusive language. Expelled individuals may not return to the pool area for a minimum of one full day. If an individual under the age of eighteen (18) is expelled, a Pool Committee member, or the Property Manager will notify the parent. The lifeguards, Pool Committee members, Advisory Board members, or the Property Manager have the authority to expel anyone. Repeated misbehavior may result in an indefinite suspension.

MEMBERSHIP GUEST PRIVILEGES

Admittance only to St Marlo residents in good standing and their guests.

1. Each St Marlo family is allowed to bring up to five (5) guests to the pool without any prior Pool Committee approval. Only adult members are allowed to have guests during non-guarded hours. At all times, St Marlo residents will be on their honor to abide by guest privilege rules.

•2. Residents not in good standing with St Marlo cannot be considered guests and will not be permitted in the pool area. The Advisory Board will apprise the Pool Committee of all unpaid residents.

PARTIES

1. All members desiring to use the pool area for a function must schedule the event through the Property Manager's office. No more than thirty-five (35) guests total will be allowed at the pool at a time, and no party shall last more than four (4) hours. A small party will be considered more than five (5) but less than ten (10) non-resident guests. Large parties will be considered eleven (11) to thirty-five (35) guests.

For parties or special events, for which the pool company is to provide lifeguards (attendees number more than 10), the Customer is responsible for giving Sweetwater Pools at least (7) day's prior written notice as to:

a. The time and date of the party.
b. The number of people who are scheduled to attend.
c. The general age group of the people scheduled to attend.
d. Whether alcoholic beverages will be permitted at the party.
e. Any special admission instructions.

The following scale shall be used to determine the number of lifeguards required at an after-hours event:

SAFETY AND SANITATION

1. For safety reasons, there can be no running, pushing, jumping in on others, jumping off the lifeguard chair, dunking or holding others under the water or loitering in the bathroom area. No diving is allowed in the shallow areas.

•2. The pool must be vacated at the first sight or sound of thunder or lightning. It must remain vacant for fifteen (15) minutes past the last occurrence of thunder or lightning.

•3. No one under the age of eighteen (18) will be allowed to swim during the designated lifeguard break period. The designated lifeguard break period will be the first fifteen (15) minutes of each hour at the top of the hour. (Children age 4 & under may swim with their parents during this period.)

•4. The wading pool is for children four (4) years of age and younger. Children in the wading pool must be supervised by a parent, adult or baby-sitter (as qualified above.)

•5. No pets, bicycles, skateboards, roller blades or other similar equipment are allowed in the pool area.

•6. No one is allowed to swim with open or infected wounds.

•7. Suntan oil must be washed off BEFORE entering the pool.

•8. Members may be required to vacate the pool during cleaning.

•9. The pool will be closed for twenty-four hours if any contaminants are found.

ATTIRE

1. Cutoffs and other improper swimwear are not allowed in the pool.

•2. Disposable diapers are NOT PERMITTED in the pool. Untrained children are required to wear swim diapers and rubber pants beneath a swimsuit. Parents will be fined $50.00 for any fecal incident resulting from violation of this rule, in addition to a charge for the cost of chemicals needed to sanitize the pool - NO EXCEPTIONS WILL BE CONSIDERED.

•3. All members, including infants & toddlers, must have appropriate clothing on at all times while at the pool.

GAMES, TOYS, ETC.

1. Exuberant games are not allowed when they interfere with the enjoyment of the pool by others.

•2. When using radios, please be considerate of other members.

•3. Water wings, children's small round floats, snorkel rubes, face masks and soft plastic balls under 12" in diameter are permitted. No automobile tubes are allowed. Air mattresses/rafts are permitted at the discretion of the lifeguard. Size limit of rafts/air mattress is 3 feet by 6 feet. Children under 12 years old are not permitted to use air mattresses/rafts unless a care provider is present. No flotation devices are allowed in the deep end.

FOOD, DRINK, ETC.

1. No one under the age of twenty-one (21) is allowed to drink alcoholic beverages. A person showing signs of intoxication may be denied use of the facilities immediately and is subject to suspension and/or expulsion of up to one month. The advisory Board will make notification when the suspension has elapsed.

•2. Smoking, eating and drinking are not permitted within 10 feet of the pool edge. Smokers are responsible for disposal of cigarette butts, providing their own non-glass ashtrays.

•3. No glass beverage containers or any other breakable containers will be allowed in the pool area.

•4. After use, members are responsible for cleaning & straightening their tables & chairs and those of their guests & children. All trash must be placed in the receptacles provided. Umbrellas should be lowered.

PERSONAL PROPERTY

1. Club members are not allowed to leave personal property in the pool area overnight. A lost and found box will be maintained in the pool area, and emptied periodically. Employees of Pool Contractor and Association are not responsible for any items left in the pool area.

ASSOCIATION EQUIPMENT

1. Pool area restrooms will be open during posted pool hours only. Only pool employees are allowed to enter the pumproom. In the absence of a pool employee, Pool committee members may enter to deal with problems.

•2. A telephone is provided in the pool area for member use only. It is primarily for emergency use. Please limit all non-emergency calls to two minutes or less.

MISCELLANEOUS

1. Members are financially responsible for any debts, damages or breakage cause by misuse or vandalism by either the member or their guest(s).

No member or guest shall reprimand or attempt to discipline any pool employee. Concerns or complaints should be brought to the attention of a Pool Committee member or the Property Manager.

If necessary to promote safety or to protect our community, these rules may be amended without notice.

Subjects not covered by the above rules will be handled by the lifeguard on duty or by the Pool Committee.

The health and safety of members and their guests is ultimately their own responsibility. By members' use of the pool facilities, members agree to and are bound by these pool rules. By members' use of the Pool, members:

•A) Assume all responsibility, risks, liabilities and hazards incident to member's use of the Pool and release and forever discharge developer and St Marlo Homeowners Association ("Association") and their officers, directors and employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability for personal injury or death and damage to or destruction of property arising from member's use of the Pool.

•B) Agree to indemnify and hold harmless the Developer and the Association and their officers, directors and employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability (including, but not limited to attorney's fees) resulting from negligence or otherwise for an injury, to any person or property, suffered by member, or member's family, employees, agents, guests, invitees or any member of the Association or any other person which arise from or are in any way related to the member's use of the Pool.

Assume all responsibility for the actions and behavior of all persons present at the Pool at the member's request or invitation and member agrees to be personally responsible for causing all such persons to comply with the rules and regulations concerning Pool use.
